{"id":3066,"date":"2020-03-11T13:09:54","date_gmt":"2020-03-11T12:09:54","guid":{"rendered":"http:\/\/alatis.eu\/?p=3066"},"modified":"2020-11-23T08:20:27","modified_gmt":"2020-11-23T07:20:27","slug":"france-trademark-law-changing","status":"publish","type":"post","link":"https:\/\/alatis.eu\/en\/france-trademark-law-changing\/","title":{"rendered":"France: Trademark Law is Changing!"},"content":{"rendered":"<section  class='av_textblock_section av-av_textblock-0366cc7376be6c9e82a3e9cc8987b64f '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock'  itemprop=\"text\" ><h1><b>France: Trademark Law is Changing!<\/b><\/h1>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-3068 aligncenter\" src=\"https:\/\/i0.wp.com\/alatis.eu\/wp-content\/uploads\/2020\/03\/trademark.jpg?resize=1000%2C667\" alt=\"France: Trademark Law is Changing!\" width=\"1000\" height=\"667\" \/><\/p>\n<p><strong>The end of 2019 was rich in new legislative and regulatory changes for trademark law in France, with new rules instigated by a series of legislative acts. <\/strong><\/p>\n<p>The changes in trademark law in France will take place in two stages.<\/p>\n<p>Most of them came into effect on December 11th, 2019 and are aimed to harmonization of trademark rules within the European Union:<\/p>\n<ul>\n<li>Extension of the types of mark open for registration;<\/li>\n<li>Extension of the renewal period (early opening);<\/li>\n<li>Increase in the number of rights on which an opposition proceeding may be based (previously: only one prior mark) and adaptation of the associated proceedings;<\/li>\n<li>Division of trademarks possible <em>even after<\/em> registration of said mark;<\/li>\n<li>New administrative proceeding for opposition, invalidity and for forfeiture of a trademark;<\/li>\n<li>Reorganization of appeals against decisions of the Trademark Office;<\/li>\n<li>Reorganization of the system of certification and collective trademarks,<\/li>\n<li>Registration of addition or removal of a representative;<\/li>\n<li>Modification of the governmental single-class tax system, since tax for filing and renewal of a trademark are now due <u>by class<\/u> (the flat-rate for three classes no longer exist);<\/li>\n<\/ul>\n<p>The new provisions will be effective to registrations \/ applications filed on or after December 11th, 2019.<\/p>\n<p>A second wave of modifications will take effect on April 1<sup>st<\/sup>, 2020. It will concern recourse against decisions of the French Trademark Office as well as the introduction of new administrative proceeding for invalidity and revocation of a trademark and subsequent modifications of them, allowing the connection between judicial and administrative procedures.<\/p>\n<p>More details on the recent changes will be provided upon request.
