This international classification is the worldwide reference used to designate\u00a0<strong>goods and services<\/strong>\u00a0for the filing and registration of trademarks. It plays a central role in the protection of distinctive signs by ensuring harmonisation among intellectual property offices.<\/p>\n<p>The Nice Classification is regularly updated in order to adapt to economic, technological and commercial developments. A\u00a0new edition is published every three years, supplemented by\u00a0annual updates\u00a0aimed at clarifying, refining or reorganising certain categories of goods and services. The 2026 edition forms part of this ongoing process of modernisation.<\/p>\n<p>Accordingly, the new classification introduces, among other things,services related to artificial intelligence in Class 42, as well as\u00a0services for reserving access to airport lounges in Class 43.<\/p>\n<p>In practical terms, the thirteenth edition applies:<\/p>\n<ul>\n<li>to\u00a0<strong>all new trademark applications<\/strong>\u00a0received by the Offices of origin as from\u00a0<strong>1 January 2026<\/strong>;<\/li>\n<li>to\u00a0<strong>any application received by WIPO<\/strong>\u00a0as from the same date, after expiry of the\u00a0<strong>two-month time limit provided for in Article 3(4) of the Madrid Protocol<\/strong>.<\/li>\n<\/ul>\n<p>It is important to emphasise that\u00a0<strong>international trademark registrations already in force<\/strong>, with a date\u00a0<strong>prior to 1 January 2026<\/strong>,\u00a0<strong>will not be subject to automatic reclassification<\/strong>. Their scope of protection therefore remains unchanged from a classification perspective.<\/p>\n<p>For applicants, this new edition requires\u00a0<strong>increased care when drafting specifications of goods and services<\/strong>, in order to ensure appropriate protection that complies with current requirements. Professional assistance may prove valuable in securing trademark filings and anticipating future developments in the classification system.<\/p>\n<p>The new edition also calls for\u00a0<strong>particular vigilance when conducting trademark searches and monitoring<\/strong>, as certain goods or services have been assigned to new classes. For example:<\/p>\n<ul>\n<li>\u201cOptical products (spectacles, sunglasses, contact lenses, frames, cases, etc.)\u201d\u00a0have been transferred from\u00a0Class 9 to Class 10, which covers medical apparatus and instruments;<\/li>\n<li>\u201cEmergency and rescue vehicles (fire engines, fireboats, lifeboats, rescue rafts, etc.)\u201d\u00a0have been transferred from\u00a0Class 9 to Class 12 (vehicles);<\/li>\n<li>etc.<\/li>\n<\/ul>\n<p>The issue is therefore a sensitive one.
