{"id":7984,"date":"2026-03-05T14:57:13","date_gmt":"2026-03-05T13:57:13","guid":{"rendered":"https:\/\/alatis.eu\/geographical-indications-for-craft-and-industrial-products-cigis-a-new-eu-protection\/"},"modified":"2026-03-05T14:58:07","modified_gmt":"2026-03-05T13:58:07","slug":"cigis-new-eu-protection","status":"publish","type":"post","link":"https:\/\/alatis.eu\/en\/cigis-new-eu-protection\/","title":{"rendered":"Geographical Indications for Craft and Industrial Products (CIGIs) : A new EU Protection"},"content":{"rendered":"<h3><strong>A Strategic Opportunity for Producers<\/strong><\/h3>\n<p>As of 1 December 2025, the\u00a0European Union Intellectual Property Office\u00a0(EUIPO) has become competent for registering the new intellectual property right covering\u00a0<strong>Geographical Indications for Craft and Industrial Products (CIGIs)<\/strong>.<\/p>\n<p>All existing national protection systems will be phased out and replaced by a\u00a0<strong>single EU-wide framework<\/strong>.<\/p>\n<h3><strong>A Harmonised Two-Phase Procedure<\/strong><\/h3>\n<p>Under the standard procedure:<\/p>\n<ul>\n<li>Producer groups and other applicants established in twenty EU Member States must file their application with their\u00a0<strong>national competent authority<\/strong>.<\/li>\n<li>The authority conducts the\u00a0<strong>national examination phase<\/strong>, including:\n<ul>\n<li>examination of the application,<\/li>\n<li>a national opposition procedure.<\/li>\n<\/ul>\n<\/li>\n<li>Once successfully completed, the application is forwarded to the EUIPO for the\u00a0<strong>Union phase examination<\/strong>, which includes:\n<ul>\n<li>verification of the absence of manifest errors,<\/li>\n<li>initiation of the EU-level opposition procedure,<\/li>\n<li>registration in the Union register.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>Applicants established in Denmark, Finland, Lithuania, Luxembourg, Malta, Netherlands and Sweden must file directly with the EUIPO.<\/p>\n<h3><strong>Protection of Existing Rights<\/strong><\/h3>\n<p>EU Member States may also seek EU protection for:<\/p>\n<ul>\n<li>CIGIs already protected under national law;<\/li>\n<li>names established by use prior to 1 December 2025.<\/li>\n<\/ul>\n<p>This ensures a smooth transition and safeguards existing rights.<\/p>\n<h3><strong>A Dedicated Digital Tool: GIportal<\/strong><\/h3>\n<p>To streamline filings, the EUIPO has launched\u00a0<strong>GIportal<\/strong>, an intuitive e-filing platform specifically designed for CIGIs, enhancing accessibility, efficiency, and transparency.<\/p>\n<h3><strong>Strong Early Interest<\/strong><\/h3>\n<p>The first weeks of implementation show significant uptake.
