BREXIT: a registered trademark in the EU
Trademark protection is granted to the word mark BREXIT in relation to goods of classes 5, 32 and 34. The decision was rendered by the EUIPO Second Board of Appeal of June 28, 2017.
The trademark application for the word mark BREXIT was filed by Brexit drink Ltd on July 8, 2016. Within a year from filing, the Board of Appeal denied the decision of the Examiner who first rejected the application.
The Board explains that the term « brexit » has a specific meaning and is a moto for withdrawal of the UK from the EU. Such a connotation is memorable and gives resonance to the term with no immediate links to the goods.
